Smart Cold respects your privacy and is committed to protecting the personal data of those who visit this website and contact us. This Privacy Policy explains, in clear terms, what data we collect, how we use it, and what your rights are, in compliance with the Brazilian General Data Protection Law (Law No. 13,709/2018 – LGPD).

Who controls your data

The controller of the personal data processed on this website is SMART COLD INTELIGÊNCIA EM REFRIGERAÇÃO LTDA, registered under CNPJ No. 43.946.873/0001-02, headquartered at Rua Eliana, 78 - Jardim Mirian, Vargem Grande Paulista/SP, postal code 06730-000.

The controller is responsible for deciding how and why your personal data is processed. For any privacy-related matter, you may contact us at contato@smartcold.com.br.

Contact and quote requests sent through the form on this website are delivered by email to Frio Ideal, which receives and handles them, as explained in Who we share your data with.

What personal data we collect

We collect personal data in the following situations:

  • Data you provide: when you fill out the contact form, we collect the information you enter: company (optional), industry, type of equipment (optional), your message, name, email, and phone. The request is sent together with the page and language of the form, the date it was sent, and, when available, the visit source described below.
  • WhatsApp message: when you submit the form, the website also opens Smart Cold's sales WhatsApp with a pre-filled message containing the data you entered (name, email, phone, company, industry, equipment, and message). This message is only sent if you confirm it in WhatsApp itself, and the conversation is subject to WhatsApp's terms and privacy policy.
  • Visit source: on the Portuguese-language pages, when you reach the website through a link with campaign parameters or from another website, your browser stores a record of the visit source (sc_attribution_v2), which is used for up to 90 days: the campaign parameters (utm), ad click identifiers (gclid and fbclid), the main address of the website you came from (for example, https://www.google.com, without the page path), and the landing page. This record does not contain your name, email, or phone. If you accept the "Análise" (Analytics) category, this source, without gclid and fbclid, also accompanies the events sent to Google Analytics. Details in our Cookie Policy.
  • Browsing data, with your consent: if you accept the "Análise" (Analytics) category in the cookie notice, Google Analytics and Microsoft Clarity collect technical and browsing information, such as pages visited, time spent, device and browser type, and approximate location data. Clarity also records the session (movements, clicks, and scrolling) and generates heatmaps, with the tool's content masking set to strict mode.
  • Technical security data: to protect the form against bots and abuse, the server that receives the submission processes your IP address, which is sent to Cloudflare together with the anti-bot check (Turnstile). This check appears in the form and also receives technical data from your browser.

We do not intentionally collect sensitive personal data or data from children and adolescents, as the website is intended for a professional audience.

How we use your data

We always use your personal data under a legal basis provided by the LGPD:

  • Responding to your contact: replying to messages sent through the form or WhatsApp, answering questions, preparing quotes, and following up on commercial requests. Requests sent through the form are handled by the Frio Ideal sales team (see Who we share your data with). Legal basis: preliminary procedures related to a contract, at the data subject's request (art. 7, V, LGPD).
  • Commercial communication: sending information about products and services where there is interest and prior contact. Legal basis: legitimate interest (art. 7, IX).
  • Source of contact requests: knowing which channel brought you to the website (search, another website, or a campaign) and recording that source together with your contact request, to assess which channels bring in contacts. Legal basis: legitimate interest (art. 7, IX). Ad click identifiers (gclid and fbclid) are also stored in this record, but they only accompany your contact request with your consent for the "Marketing e anúncios" (Marketing and ads) category (art. 7, I).
  • Website analysis and improvement: understanding how the website is used and improving the browsing experience. Legal basis: consent, for analytics and marketing cookies (art. 7, I).
  • Website security and operation: ensuring correct functioning, preventing fraud and abuse of the form, and protecting our systems. Legal basis: legitimate interest (art. 7, IX).
  • Compliance with legal obligations: when processing is necessary to comply with an obligation set out in law. Legal basis: compliance with a legal or regulatory obligation (art. 7, II).

Who we share your data with

Smart Cold does not sell your personal data. We may share it in the following situations:

  • Frio Ideal, which handles contact requests: requests sent through the form on this website are delivered by email to the contato@frioideal.com.br mailbox and are received and handled by the sales team of FRIO IDEAL CONSTRUCAO CIVIL E REFRIGERACAO LTDA ("Frio Ideal"), CNPJ 14.725.616/0001-34. Frio Ideal is an independent company in the same group as Smart Cold and the exclusive authorized technical service provider for Smart Cold equipment. The same team handles contacts for both companies and records each request in the group's internal service spreadsheet, which has restricted access, where it follows up on each request and identifies the company the contact came from.
  • Service providers: companies that support the operation of the website, the form, and customer service, and that process the data according to the instructions of the company that hired them:
    • Cloudflare: hosts the website, runs the form, and performs the anti-bot check (Turnstile). The form's technical logs do not include the data you fill in;
    • Resend: delivers the form message by email to the team that handles it;
    • GoDaddy: hosts the mailbox that receives the requests (contato@frioideal.com.br);
    • Google (Google Sheets): stores the internal service spreadsheet;
    • WhatsApp: conversation channel, when you confirm sending the pre-filled message or contact us there; the conversation is subject to WhatsApp's terms and privacy policy.
  • Measurement tools: Google Analytics (Google) and Microsoft Clarity (Microsoft) receive browsing and site interaction data, such as pages visited and the form submission, without your contact data, only with your consent and only on the Portuguese-language pages. Smart Cold and Frio Ideal, companies of the same group, use the same Google Tag Manager and Google Analytics account to measure both websites, with each website's data kept separate. The website does not currently run ads or use advertising tools (such as Google Ads and Meta); if they are activated, they will only work with your consent for the "Marketing e anúncios" (Marketing and ads) category, and this Policy will be updated.
  • Legal obligation or order from an authority: when sharing is required by law, regulation, or a determination from a competent authority.

In any case, we seek to share only the necessary data and to require appropriate protection standards from our partners.

Cookies and tracking technologies

This website uses cookies and similar technologies to function correctly, to record the visit source, and, with your consent, to analyze page usage and support marketing activities. On the Portuguese-language pages, a notice lets you accept, reject, or manage analytics and marketing cookies. The English and Spanish pages do not load analytics or marketing tools and therefore do not show this notice.

The details (which cookies we use, their purposes, how long they stay in your browser, and how to manage them) are available in our Cookie Policy.

International data transfer

The providers mentioned in this Policy (Google, Microsoft, Cloudflare, Resend, GoDaddy, and WhatsApp) may store and process data on servers located outside Brazil. In these cases, an international data transfer occurs, carried out in compliance with the LGPD and prioritizing providers that adopt adequate protection safeguards.

How long we keep your data

We keep your personal data only for as long as necessary to fulfill the purposes for which it was collected:

  • Contact and quote requests: requests that do not lead to a contract are kept for up to 12 months after the last contact, including in the mailbox of the team that handles them and in the internal service spreadsheet, reviewed monthly and deleted at the end of that period. If a contract is entered into, the necessary records are kept for the performance of the contract, compliance with legal obligations, and the exercise of rights, for the applicable period.
  • Form technical logs: they do not include the data you fill in and are kept for the period available at the hosting provider, up to 7 days.
  • Visit source (sc_attribution_v2): it is used for up to 90 days from when it was first recorded. After that period, the website stops using it and deletes it the next time you submit the form or click the WhatsApp or Frio Ideal links on the Portuguese-language pages of this website, or replaces it when you return through a campaign link or from another website. Until then it remains in your browser, and you can delete it by clearing this website's data in your browser settings.
  • Browsing data: in Google Analytics, event-level and user-level data is kept for 14 months; in Microsoft Clarity, for the retention period set by Microsoft for the tool.

Once these periods end, the data is securely deleted or anonymized. You may request deletion earlier at the email address indicated in this Policy, subject to the legal retention requirements.

How we protect your data

We adopt technical and administrative measures to protect personal data against unauthorized access, loss, alteration, or improper disclosure, including the use of a secure connection (HTTPS), an anti-bot check on the form, access to contact requests restricted to the team responsible for handling them and to the people who administer the group's accounts, and careful selection of service providers. No system is entirely immune to risk, but we work continuously to keep information secure.

Your rights as a data subject

The General Data Protection Law grants you, as a personal data subject, the following rights:

  • Confirmation that we process your data;
  • Access to the personal data we hold about you;
  • Correction of incomplete, inaccurate, or outdated data;
  • Anonymization, blocking, or deletion of unnecessary or excessive data, or data processed in non-compliance with the law;
  • Portability of data to another provider, upon request;
  • Deletion of personal data processed based on your consent;
  • Information about the entities with which we share your data;
  • Information about the possibility of not providing consent and about the consequences of refusal;
  • Objection to processing carried out based on other legal grounds, in case of non-compliance with the LGPD;
  • Withdrawal of consent at any time.

To exercise any of these rights, simply contact us at contato@smartcold.com.br. We will address your request as quickly as possible, within the timeframes set out in the legislation.

How to contact us about privacy

If you have questions about this Privacy Policy or about the processing of your data, or wish to exercise your rights, contact us at contato@smartcold.com.br.

You also have the right to file a complaint with the Brazilian National Data Protection Authority (ANPD) if you believe your data is not being properly handled.

Changes to this Policy

This Privacy Policy may be updated periodically to reflect changes in our practices, in the tools we use, or in the legislation. The version and date of the last update are shown at the top of this page. We recommend that you review it regularly.
